FDA 510(k)

FDA 510(k) is a premarket notification submitted to the U.S. Food and Drug Administration to show that a medical device is substantially equivalent to a legally marketed predicate device. A successful 510(k) results in FDA clearance, not approval, allowing the device to be legally marketed in the United States.


What is FDA 510(k)?

FDA 510(k) takes its name from Section 510(k) of the Federal Food, Drug, and Cosmetic Act. Most Class II medical devices, along with certain Class I and Class III devices, enter the U.S. market through this pathway instead of Premarket Approval (PMA).

The principle behind the process is substantial equivalence. Rather than proving safety and effectiveness from the beginning, the manufacturer demonstrates that its device has the same intended use and either the same technological characteristics or different technological characteristics that do not raise new questions of safety and effectiveness, compared with a legally marketed predicate device.

If the FDA agrees, it issues a Substantially Equivalent (SE) determination, commonly referred to as 510(k) clearance. Clearance authorizes commercial distribution in the United States but is legally different from FDA approval.


Why FDA 510(k) matters in medical device development

A required 510(k) is the legal gateway to the U.S. market. Marketing a device that requires clearance without obtaining it can cause the FDA to consider the device adulterated or misbranded, potentially resulting in warning letters, import detention, recalls, seizures, civil penalties, or injunctions.

The pathway also drives the development strategy. Predicate selection influences device design, testing requirements, labeling, timelines, and regulatory costs. Although the FDA’s review goal for a Traditional 510(k) is 90 FDA review days, real-world timelines frequently extend because of Additional Information (AI) requests, incomplete testing, or poor predicate selection.

The original clearance also establishes the regulatory baseline for future product modifications. Manufacturers must continually assess whether design or labeling changes require submission of a new 510(k).


How the FDA 510(k) process works

A 510(k) submission is a structured technical comparison governed by 21 CFR Part 807 Subpart E. Since October 1, 2023, nearly all submissions must be prepared electronically using the FDA’s eSTAR template.

A typical workflow includes:

  • Identify a predicate device. Select one or more legally marketed devices with the same intended use and comparable technological characteristics.
  • Confirm regulatory classification. Verify the product code, regulation number, device class, and whether a 510(k), De Novo, PMA, or exemption applies.
  • Generate supporting evidence. Depending on the device, this may include:
    • Bench performance testing
    • Biocompatibility (ISO 10993)
    • Sterile barrier validation (ISO 11607)
    • Electrical safety and EMC (IEC 60601-1)
    • Software lifecycle documentation (IEC 62304)
    • Cybersecurity documentation
    • Risk management (ISO 14971)
  • Prepare the eSTAR submission. Include device description, indications for use, substantial equivalence comparison, labeling, sterilization information, software documentation, performance testing, and declarations.
  • Acceptance Review. FDA performs a Refuse-to-Accept (RTA) screening within 15 calendar days to verify administrative completeness.
  • Substantive Review. FDA evaluates the scientific evidence and may issue one or more Additional Information (AI) requests.
  • Clearance. Once substantial equivalence is established, the FDA issues an SE letter, and the device may be commercially marketed.

The submission is supported by documentation generated through the manufacturer’s Quality Management System. Since February 2, 2026, these quality system requirements are governed by the FDA’s Quality Management System Regulation (QMSR), which incorporates ISO 13485:2016 by reference.


Common challenges and best practices

The most common cause of delay is selecting the wrong predicate. A predicate with a different intended use or significantly different technology can result in a Not Substantially Equivalent (NSE) decision or force additional testing.

Incomplete testing is another frequent issue. FDA reviewers commonly identify missing performance data, insufficient validation, inconsistent labeling, or incomplete software documentation during review.

Successful programs typically:

  • Select and justify the predicate before design freeze.
  • Use the FDA’s Q-Submission (Pre-Sub) program to obtain feedback on testing plans.
  • Build substantial equivalence tables that clearly compare intended use, technological characteristics, performance testing, and labeling.
  • Align design controls, risk management, verification, validation, and labeling from the beginning rather than reconstructing documentation before submission.
  • Ensure every performance claim is supported by objective evidence.
