CE Marking

CE Marking is a mandatory conformity mark that shows a medical device meets the safety, performance, and labeling requirements of EU Regulation 2017/745 (MDR) or 2017/746 (IVDR). It lets the manufacturer legally place the device on the EU and EEA market after completing the required conformity assessment.


What is CE Marking?

CE stands for Conformité Européenne, meaning European Conformity. Applied to a medical device, the mark is the manufacturer’s declaration that the product satisfies the General Safety and Performance Requirements (GSPRs) in Annex I of the EU Medical Device Regulation (MDR), Regulation (EU) 2017/745, or the In Vitro Diagnostic Regulation (IVDR), Regulation (EU) 2017/746 for IVDs.

The MDR entered into force in 2017 and became fully applicable on 26 May 2021, replacing the older Medical Device Directive. CE Marking sits near the end of the development pathway: a device earns it only after design, risk management, clinical evaluation, and technical documentation are complete. It is not a one-time approval. The mark stays valid only while the manufacturer keeps meeting MDR obligations across the product lifecycle.


Why CE Marking matters in medical device development

CE Marking is the gate to the European market. Without it, a device cannot legally be placed on sale across the 27 EU member states or the wider EEA, so the decisions that lead to it shape budget, timeline, and market access from the first design review.

The stakes are high. A rejected technical file or a failed Notified Body audit can delay launch by many months, and Notified Body waiting lists have stretched review timelines further. Devices already on the market face withdrawal if compliance lapses. Because the mark reflects the GSPRs and the underlying quality system, gaps in risk files, clinical evidence, or labeling surface during assessment rather than after, which is where remediation gets expensive. Planning the conformity route early keeps these costs contained.


How CE Marking works

The conformity assessment route depends on the device’s risk class, determined by the classification rules in Annex VIII of the MDR. A typical path looks like this:

  • Confirm the device qualifies as a medical device under Article 2. Then assign its class (I, IIa, IIb, or III).
  • Build the quality management system. Generally, align it to ISO 13485:2016 and appoint a Person Responsible for Regulatory Compliance (PRRC).
  • Compile the technical documentation. Prepare documentation under Annexes II and III, covering design, risk management to ISO 14971, verification and validation, biocompatibility, and clinical evaluation under Article 61.
  • Select the conformity assessment procedure. Follow Article 52. Class I self-certified devices need no Notified Body; Class I sterile, measuring, or reusable surgical instruments and all Class IIa, IIb, and III devices require Notified Body involvement.
  • Undergo Notified Body assessment. The Notified Body audits the QMS, reviews the technical documentation, and may perform product testing.
  • Register in EUDAMED. Obtain a Single Registration Number (SRN) and assign the Unique Device Identifier (UDI) under Article 27.
  • Sign the EU Declaration of Conformity. Complete the Annex IV Declaration of Conformity and affix the CE Mark, including the Notified Body’s four-digit identification number where applicable.

Electromechanical devices usually require compliance with additional standards such as IEC 60601-1 for electrical safety and IEC 62304 for software lifecycle. Manufacturers located outside the EU must also appoint an EU Authorized Representative before placing the device on the market.


Common challenges and best practices

Incomplete technical files are among the most frequent causes of delay. Teams often underestimate the clinical evidence the MDR now expects, especially for devices reclassified upward, and discover the gap only during Notified Body review. Weak traceability between requirements, risk controls, and verification records is another recurring finding.

Successful manufacturers typically:

  • Classify the device early and document the classification rationale.
  • Confirm Notified Body availability before beginning submission preparation.
  • Treat the GSPR checklist as a live traceability document linked to supporting evidence.
  • Build EUDAMED actor and device registration into the overall regulatory timeline.
  • Maintain technical documentation continuously instead of assembling it immediately before submission.

One more point worth tracking: the European Commission published a proposal in December 2025 to simplify the MDR and IVDR. It is still a proposal moving through the legislative process, not enacted law, so current requirements remain fully applicable until any amendments are formally adopted.

Is CE marking mandatory for all medical devices sold in the EU?
